New rules for where cash-dispensing machines can be placed are coming into effect.
From 1 January 2025, all cash dispensing machines (ATMs and EFTPOS that allow cash withdrawals) must be located at least five metres away from any entrance or exit to a gaming area in the club.
Additionally, these machines must not be visible from any gaming machine or the entrance to a gaming area.
Compliance is required by 1 January 2025
Liquor & Gaming NSW (L&GNSW) has advised the following in relation to compliance measures:
- Between 1 January and 31 January 2025, compliance action will be taken where clubs have made no effort (or inadequate effort) to comply with (or seek exemption from) the five metre radius requirement. Evidence of reasonable steps taken to relocate their cash dispending machine or seek an exemption, along with proof that any delays were beyond their control, should be provided.
- From 1 February 2025, a zero-tolerance enforcement approach to cash dispending machine locations will begin.
Situations where you can request an exemption
There are some circumstances in which venues may be eligible for an exemption, including:
- The Environmental Planning and Assessment Act 1979, the regulations under that Act or an environmental planning instrument, or
- The Work Health and Safety Act 2011 or the regulations under that Act.
Clubs can apply for the exemption online here.
Additional information is available on L&GNSW’s website, available here.
