Changes to Cash Dispensing Facility Signage Now Enforceable by L&GNSW
As part of reforms to gambling harm minimisation requirements in NSW, changes to cash dispensing facility signage in clubs with gaming machines were introduced on 1 July 2024. These changes are enforceable from 1 August 2024.
Key Points
- Clubs need to comply with new reforms for gambling harm minimisation.
- Changes to cash dispensing facility signage, visibility and location.
As a reminder, from 1 July 2024, clubs must not:
- Have any signage or advertising relating to gaming machines that is visible from an Automatic Teller Machine (ATM) or EFTPOS with cash withdrawal facilities (cash dispensing facility).
- Have any sign that advertises or gives directions to a cash dispensing facility that is visible from a gaming machine or any part of a gaming area.
Liquor & Gaming NSW (L&GNSW) will be enforcing these changes from 1 August 2024 in line with their Compliance Campaign position paper, available here.
From 1 January 2025, the following will come into effect for cash dispensing facilities:
- Cash dispensing facilities must be located outside of a five-metre radius* of any entrance or exit from a gaming area in a club;
- Cash dispensing facilities must not be visible from:
- the entry to a gaming room or area or room where gaming machines are located,
- a gaming machine.
- You must not be able to view a gaming machine or jackpot sign from a cash dispensing facility.
*L&GNSW has advised the distance requirement refers to a ‘radius’ and does not allow for cash dispensing facilities within that area, even if the walking distance is greater than five metres. The distance is calculated from the nearest side of the cash dispensing facility to the nearest point of the gaming room entrance.
Exemption
For clubs who are unable to comply with the five-metre radius requirement, there will be a process to apply for an exemption (subject to the following criteria):
- The Environmental Planning and Assessment Act 1979, the regulations under that Act or an environmental planning instrument, or
- The Work Health and Safety Act 2011 or the regulations under that Act.
L&GNSW has advised that applications for an exemption will be accepted from 1 September 2024. We will provide more information on the exemption process and FAQs once L&GNSW releases it.
